Constantly functioning arbitration court is a non-state independent body formed by approbation of or the corresponding decision of interested physical and/or legal persons by way of, established by the Law of Ukraine «About the arbitration courts» for the resolution of disputes, arising from civil and economic legal relationship.

In its activity constantly functioning arbitration court is guided by norms of the Law of Ukraine about the arbitration courts, Regulations about constantly functioning arbitration court, and the Rules of constantly functioning arbitration court.

Privileges of adjudication of disputes in constantly functioning arbitration court, in comparison with proceeding in economic courts and courts of the general jurisdiction, consist in the following:

• adjudication of disputes in constantly functioning arbitration court is carried out in shorter terms;
• absence of an appellate procedure of the decision of the arbitration court in appeal and cassation instances;
• the decision of constantly functioning arbitration court is obligatory for execution by the parties of dispute. In case of default by the party of the decision of constantly functioning arbitration court voluntary, procedure of compulsory execution of the decision on the basis of the executive document which has been given out by economic or general court, according to the Law of Ukraine «About enforcement proceeding» is applied";
• the arbitration agreement is an additional guarantee of execution by the parties of obligations;
• confidentiality of arbitration adjudication of dispute;
• charges on arbitration adjudication can be carried in structure of total charges, according to the Law of Ukraine «About the taxation of profit of the enterprises».

The jurisdiction of constantly functioning arbitration court covers the cases arising from civil and economic legal relationship, among which following categories present:

• collection of debts;
• contest of the property right to the real estate (inhabited and uninhabited premises, movables, the ground areas, objects of not completed construction);
• other disputes.
